As the 1973 Yom Kippur war between Israel and neighboring Arab states intensified, I was in an underground missile launch center in Montana with a crewmate when we received an emergency message to prepare for nuclear war with the Soviet Union. We trusted the president to defuse the crisis and avert a nuclear war. Dwight D. Eisenhower recoiled at the concept of nuclear overkill, where far more people are killed than necessary to defeat an enemy. Richard M. Nixon (president during the 1973 Arab-Israeli war) ... worried about the way war plans “lightly tossed about millions of deaths.” Ronald Reagan, for all his thunder about the Soviet Union being “an evil empire” and joking that “we begin bombing in five minutes,” was privately averse to nuclear weapons. Donald J. Trump is of a radically different ilk and temperament from past presidents. In 1973, as it turned out, President Nixon was not in charge when the order came down to prepare for nuclear conflict. Under stress from the Watergate scandal, he had retired for the evening, drunk. His unelected advisers, led by the national security adviser, Henry A. Kissinger, and Defense Secretary James R. Schlesinger, ran the show that night. Our trust in the president was misplaced. He was not even awake when my crewmate and I saddled up for nuclear war. The president had lost personal control of the situation. But upon reflection, it would have been far scarier if a cocksure Mr. Trump, consulting no one but himself, had been there calling the shots.

‘Sodomized’ Guantánamo captive to undergo rectal surgery

An alleged accomplice in the Sept. 11 terror attacks is to undergo surgery this week for decade-old damage from his “sodomy” in CIA custody, his attorney says. Defense attorney Walter Ruiz, a Navy Reserve officer, disclosed the upcoming surgery for his client, Mustafa al Hawsawi, 48, on the eve of pretrial hearings Tuesday in the case that accuses the Saudi Arabian Hawsawi and four other men of orchestrating the Sept. 11, 2001, terror attacks. Ruiz said a case prosecutor informed him of the procedure over the weekend. Defense lawyers have been litigating over conditions at the remote prison and, in the case of their client, have specifically sought medical intervention to treat a rectal prolapse that has caused Hawsawi to bleed for more than a decade. The disclosure comes days after The New York Times published a detailed account of former CIA and Guantánamo captives grappling with the aftereffects of torture. Hawsawi was denied a request to have a member of his legal team on standby near the surgery. He has sat gingerly on a pillow at the war court since his first appearance in 2008. But the reason was not publicly known until release of a portion of the so-called Senate Torture Report on the CIA program ... which described agents using quasi-medical techniques called “rectal rehydration” and “rectal re-feeding.” Former CIA captives like Hawsawi are segregated in a clandestine lockup called Camp 7 that has been described ... as having its own medical facility, the capabilities of which are not known.

How 10 mega-donors already helped pour a record $1.1 billion into super PACs

Super PACs seeking to influence the 2016 elections have collected more than $1 billion, a record haul driven by jumbo-sized contributions from rich donors on both sides of the aisle. Just 10 mega-donor individuals and couples contributed nearly 20 percent of the $1.1 billion raised by super PACs by the end of August. The total exceeds the $853 million that super PACs collected in the entire 2012 cycle. The top givers were split roughly equally along party lines, with five Republicans, four Democrats and one independent. Together, super PACs seeking to sway the White House and congressional races have pumped more than $674 million into TV ads and other outreach through September, filings show. By the end of the 2012 elections, such groups had spent $608 million. The figures illustrate how American campaigns have been reordered by the ability to give unlimited sums to political committees. In the six years since the Supreme Court’s Citizens United v. Federal Election Commission decision created new paths for massive contributions to flow into elections, a tiny sliver of donors with immense financial capacity have rushed to participate. Court refuses to release names of US-trained military leaders

Activists have no right to force public disclosure of the names of Latin American military leaders trained at a U.S. Army installation formerly known as the School of the Americas, a divided federal appeals court ruled Friday. A federal judge had ruled in 2013 that the government must identify students and instructors at the school at Fort Benning, Ga., whose graduates have included Panamanian strongman Manuel Noriega and Salvadoran death squad leader Roberto d’Aubuisson. But in a 2-1 ruling Friday, the Ninth U.S. Circuit Court of Appeals ... said the information had little public value, and that disclosure would invade the trainees’ privacy. “There are many groups in foreign countries that would seek to harm those who are publicly associated with the United States military,” Judge Sandra Ikuta said in the majority opinion. She also cited assurances by the Defense Department and an oversight board that the school ... is complying with a federal law that requires it to instruct students about human rights. Federal law additionally requires the department to deny enrollment to any member of a military unit that has committed a “gross violation of human rights,” Ikuta said. Dissenting Judge Paul Watford said the majority was taking the government’s word that everything was in order — a “fox-guarding-the-henhouse notion” — despite past revelations of abuses by School of the Americas graduates. He noted that past training materials disclosed by the Pentagon in 1996 included manuals providing “instruction on torturing and executing insurgents.”

NYPD sent undercover officers to Black Lives Matter protest, records reveal

Legal papers filed by the New York police department reveal that the department sent its own undercover officers to protests led by Black Lives Matter after the death of Eric Garner. The NYPD documents also show that it collected multimedia records about the protests. The revelations come from the same records request that led to the Intercept’s release of documents last summer showing that MTA and Metro-North transit police had regularly spied on Black Lives Matter protesters in and around Grand Central, deploying plainclothes officers to monitor demonstrations, track their movements, and share photos of activists. The NYPD’s newly revealed operations are potential constitutional violations. “The fear and disarming effect caused by undercovers being assigned to what were and continue to be extraordinarily peaceful protests is disturbing,” said MJ Williams, one of the attorneys involved in the records request. “As someone who was present at the protests, it’s disturbing to know the NYPD may have a file on me, ready to be used or to prevent me from getting a job simply because I’ve been active in some political capacity.” The MTA and Metro-North disclosures from last summer revealed that transit police tracked activists’ locations and shared images of some activists. U.S. to pay 17 Indian tribes $492 million to settle long-standing disputes

The Obama administration has settled lawsuits with 17 Native American tribes that accused the federal government of long mismanaging their funds and natural resources. With these settlements, the administration will have resolved the majority of outstanding claims, some dating back a century, with more than 100 tribes and totaling more than $3.3 billion. The settlements announced Monday, totaling $492.8 million, come at the same time that thousands of Native Americans representing tribes from across the country have joined the Standing Rock Sioux Tribe in North Dakota to protest the 1,172-mile Dakota Access Pipeline, which they say threatens their water supply and traverses sacred Indian burial grounds. This month, a federal judge ruled against the Standing Rock tribe’s request to halt construction of the crude-oil pipeline. Meanwhile, thousands of Native Americans remain camped out in a nearby field in protest. Native leaders also protested the pipeline Monday in Washington outside the White House Tribal Nations Conference, where tribal leaders met with President Obama. The 17 tribes affected [by the settlements] had accused the federal government of mismanaging trust lands, which are leased for timber harvesting, farming, grazing, and oil and gas extraction, among other uses.

In 1940, as plans were made to invade France through the Ardennes mountains, a “stimulant decree” was sent out to army doctors, recommending that soldiers take [Pervitin]. The invasion of France was made possible by the drugs. In Berlin, Hitler was [prescribed injections of] a designer opiate. He would combine it with twice daily doses of the high grade cocaine. The effect of the drugs could appear to onlookers to be little short of miraculous. One minute the Führer was so frail he could barely stand up. Chromium-6: 'Erin Brockovich' chemical threatens two-thirds of Americans

But chromium-6 contamination of America’s drinking water is an ongoing battle the US Environmental Protection Agency (EPA) is losing. Nearly 200 million Americans across all 50 states are exposed to unsafe levels of chromium-6 or hexavalent chromium, a heavy metal known to cause cancer in animals and humans, according to a new report released Tuesday by the nonprofit research and advocacy organization Environmental Working Group (EWG). In their analysis of the EPA’s own data collected for the first nationwide test of chromium-6 contamination in US drinking water, the [EWG] found that 12,000 Americans are at risk of getting cancer. “More than two-thirds of Americans’ drinking water supply has more chromium than the level that California scientists say is safe – a number that’s been confirmed by scientists in both New Jersey and North Carolina,” according to [report co-author Bill] Walker. “Despite this widespread contamination, the US currently has no national drinking water standard for chromium-6.” Erin Brockovich urges Americans to disregard the EPA’s reassurances and to take a more active role in their communities to fix the country’s broken water supply.

Family of Italian Killed in Drone Strike Gets More Than $1 Million Payment From U.S.

The United States paid over a million euros to the family of Giovanni Lo Porto, an Italian aid worker killed in a U.S. drone strike in January of last year, according to newly released documents. The 37-year-old Lo Porto died when CIA drones struck an al Qaeda compound where he was being held hostage along with Warren Weinstein, an American humanitarian worker. In a rare admission of responsibility, President Barack Obama acknowledged the strike and promised compensation for the families. The Intercept first reported that the family had reached a settlement with the U.S. government in July. The document also states that the agreement does not imply “a waiver of sovereign or personal immunity.” Lawyers for the Lo Porto family had pressed the Italian state prosecutor to consider a criminal case against the United States, while acknowledging that the chances of such a case going forward were slim. They also asked for more information from U.S. agencies about the strike and its aftermath. The U.S. has, in a few instances, paid hundreds of thousands of dollars to the families of civilians killed in attacks in Yemen, but has not publicly acknowledged doing so. Drake, prosecuted under the 1917 Espionage Act, was eventually acquitted ... but his career was ruined. House Passes Sept. 11 Legislation as Obama Veto Threat Looms

Congress sent President Barack Obama a bipartisan bill that would allow families of Sept. 11 victims to sue the government of Saudi Arabia, putting lawmakers on a collision course with the White House. The House passed the legislation Friday by voice vote, about four months after the measure cleared the Senate despite vehement objections from Saudi Arabia. Fifteen of the 19 hijackers were Saudi nationals. The legislation gives victims' families the right to sue in U.S. court for any role that elements of the Saudi government may have played in the 2001 attacks that killed thousands. The White House has signaled Obama would veto the legislation. The Obama administration has warned that if U.S. citizens can take the Saudis to court, then a foreign country could in turn sue the United States. Votes from two-thirds of the members in the House and Senate would be needed to override a veto. Last March, when President Obama travelled to Argentina to meet with the country's new President, Mauricio Macri, his public appearances were dogged by protesters who noisily demanded explanations, and apologies, for U.S. policies, past and present. There are few countries in the West where anti-Americanism is as vociferously expressed as in Argentina, where a highly politicized culture of grievance has evolved in which many of the country's problems are blamed on the United States. On the left, especially, there is lingering resentment over the support extended by the U.S. government to Argentina's right-wing military, which seized power in March of 1976 and launched a "Dirty War" against leftists that took thousands of lives over the following seven years. Obama's visit coincided with the fortieth anniversary of the coup. He pointedly paid homage to the Dirty War's victims by visiting a shrine built in their honor on the outskirts of Buenos Aires. In an address he gave at the shrine, Obama acknowledged what he characterized as American sins of omission, but he stopped short of issuing an outright apology. "Democracies have to have the courage to acknowledge when we don't live up to the ideals that we stand for," he said. "And we've been slow to speak out for human rights, and that was the case here."

Bolivia opens 'anti-imperialist' military school to counter US foreign policies

Bolivia’s president Evo Morales has opened a new “anti-imperialist” military academy to counter US policies and military influence in Latin America. “If the empire teaches domination of the world from its military schools, we will learn from this school to free ourselves from imperial oppression,” the country’s first indigenous president said. “We want to build anti-colonial and anti-capitalist thinking with this school that binds the armed forces to social movements and counteracts the influence of the School of the Americas that always saw the indigenous as internal enemies,” he told a crowd that included the defense ministers of Venezuela and Nicaragua. Some Latin American officers trained at the US-based School of the Americas went on to commit atrocities under 20th century military dictatorships. In 2000, the academy at Fort Benning, Georgia, was renamed the Western Hemisphere Institute for Security Cooperation. Morales, who expelled the US ambassador and counter-narcotics agents in 2008, accused Washington of encouraging “congressional coups” such as the impending impeachment trial of suspended President Dilma Rousseff in Brazil. He also said the US promotes global terrorism through military interventions, citing the rise of the Islamic State group as an example. Some Women Won’t ‘Ever Again’ Report a Rape in Baltimore

America has been enmeshed in a wrenching discussion about how the police treat young black men. But this week’s blistering report from the Justice Department on police bias in Baltimore also exposed a different, though related, concern: how the police in that majority-black city treat women, especially victims of sexual assault. In six pages of the 163-page report documenting how Baltimore police officers have systematically violated the rights of African-Americans, the Justice Department also painted a picture of a police culture deeply dismissive of sexual assault victims and hostile toward prostitutes and transgender people. It branded the Baltimore Police Department’s response to sexual assault cases “grossly inadequate.” Baltimore officers sometimes humiliated women who tried to report sexual assault, often failed to gather basic evidence, and disregarded some complaints filed by prostitutes. Some officers blamed victims or discouraged them from identifying their assailants. And the culture seemed to extend to prosecutors, investigators found. In one email exchange, a prosecutor referred to a woman who had reported a sexual assault as a “conniving little whore.” A police officer, using a common text-message expression for laughing heartily, wrote back: “Lmao! I feel the same.” Other “pattern or practice” investigations of police departments - including in New Orleans; Puerto Rico; and Missoula, Mont. - have also identified gender bias.

The Nauru files: 2,000 leaked reports reveal scale of abuse of children in Australian offshore detention

The devastating trauma and abuse inflicted on children held by Australia in offshore detention has been laid bare in the largest cache of leaked documents released from inside its immigration regime. More than 2,000 leaked incident reports from Australia’s detention camp for asylum seekers on the remote Pacific island of Nauru – totalling more than 8,000 pages – are published by the Guardian today. The Nauru files set out as never before the assaults, sexual abuse, self-harm attempts, child abuse and living conditions endured by asylum seekers held by the Australian government, painting a picture of routine dysfunction and cruelty. Children are vastly over-represented in the reports. More than half of the 2,116 reports – a total of 1,086 incidents, or 51.3% – involve children, although children made up only about 18% of those in detention on Nauru during the time covered by the reports, May 2013 to October 2015. The findings come just weeks after the brutal treatment of young people in juvenile detention in the Northern Territory was exposed. Allegations of sexual assault ... are a persistent theme of the files. In one report an asylum seeker described being told she was “on a list” written by local Nauruan guards naming single women they were “waiting for”. In [another] report a “cultural adviser” for Wilson Security, the company that employs guards at the detention camp, allegedly told an asylum seeker who had been sexually assaulted in camp that “rape in Australia is very common and people don’t get punished”.

How the US Spies on Medical Nonprofits and Health Defenses Worldwide

As part of an ongoing effort to exploit medical intelligence, the National Security Agency teamed up with the military-focused Defense Intelligence Agency to extract medical SIGINT from the intercepted communications of nonprofit groups starting in the early 2000s, a top-secret document shows. Medical intelligence can include information about disease outbreaks; the ability of a foreign regime to respond to chemical, biological, and nuclear attacks; the capabilities of overseas drugs companies; advances in medical technology; medical research, and the medical response capabilities of various governments, according to the document and others like it, provided by NSA whistleblower Edward Snowden. One of the more prominent examples of focused medical spying came in 2010, when the agency crafted a plan to stow tracking devices with medical supplies bound for an ill Osama bin Laden in order to locate the terrorist leader. One article from August 2003 identifies an NSA project to keep an eye on the evolution of biotechnology in various countries. Police will be required to report officer-involved deaths under new US system

Police departments will be required to give the US justice department full details of deadly incidents involving their officers each quarter, under a new government system for counting killings by police that was influenced by the Guardian. Announcing a new program for documenting all “arrest-related deaths”, federal officials said they would actively work to confirm fatal cases seen in media reports and other open sources rather than wait for departments to report them voluntarily. The new system, which aims to replace a discredited count by the FBI, mirrors that of The Counted, an ongoing Guardian effort to document every death caused by law enforcement officers. Writing in the Federal Register, Department of Justice officials said their new program should increase transparency around the use of force by police and improve accountability for the actions of individual officers. The federal government has kept no comprehensive record of killings by police officers, even as a series of controversial deaths set off unrest in cities across the country over the past two years. An annual voluntary count by the FBI of fatal shootings by officers has recorded only about half the true number. The new system is being overseen by the department’s bureau of justice statistics (BJS). It would, like the Guardian’s, document deaths caused by physical force, Taser shocks and some vehicle crashes caused by law enforcement in addition to fatal shootings by officers.
