Top Bush administration officials in 2002 debated testing the Constitution by sending American troops into the suburbs of Buffalo to arrest a group of men suspected of plotting with Al Qaeda, according to former administration officials. Some of the advisers to President George W. Bush, including Vice President Dick Cheney, argued that a president had the power to use the military on domestic soil to sweep up the terrorism suspects, who came to be known as the Lackawanna Six, and declare them enemy combatants. A decision to dispatch troops into the streets to make arrests has few precedents in American history, as both the Constitution and subsequent laws restrict the military from being used to conduct domestic raids and seize property. The Fourth Amendment bans “unreasonable” searches and seizures without probable cause. And the Posse Comitatus Act of 1878 generally prohibits the military from acting in a law-enforcement capacity. In the discussions, Mr. Cheney and others cited an Oct. 23, 2001, memorandum from the Justice Department that, using a broad interpretation of presidential authority, argued that the domestic use of the military against Al Qaeda would be legal because it served a national security, rather than a law enforcement, purpose. “The president has ample constitutional and statutory authority to deploy the military against international or foreign terrorists operating within the United States,” the memorandum said. The memorandum was declassified in March. But the White House debate about the Lackawanna group is the first evidence that top American officials ... actually considered using the document to justify deploying the military into an American town to make arrests.

But many of his steps remain unfamiliar: Kennedy's back-channel dialogue with Khrushchev and their shared pursuit of common ground; his secret opening to dialogue with Fidel Castro (ongoing the very week of his assassination); and his determination to pull out of Vietnam after his probable re-election in 1964. Drugs giant GlaxoSmithKline was accused of cashing in on swine flu after it revealed its profits have risen 10 per cent since the virus was identified. It announced profits yesterday of Ł2.1billion in the past three months. Sales of vaccines and antiviral drugs could push the figure up even higher. GSK chief executive Andrew Witty admitted the swine flu crisis would be a 'significant financial event for the company'. Sales of the company's Relenza inhaler, an alternative to Tamiflu used by pregnant women among others, are expected to top Ł600million. And this figure could be boosted by up to Ł2billion once deliveries of the swine flu vaccine begin in September. But Mr Witty denied Europe's biggest drugs company was gearing up to cash in. He admitted it was planning to charge the UK Ł6 a jab, but vociferously denied reports it cost a pound to manufacture. Liberal Democrat health spokesman Norman Lamb said: 'This is clearly a bonanza for the company. This is a staggeringly substantial return. I will write to the National Audit Office to determine whether we got the best deal for the taxpayer.' Susi Squire of the TaxPayers' Alliance said: 'We need an assurance from the Government that they have got the most competitive rate out of GlaxoSmith-Kline.' Geoff Martin of London Health Emergency said: 'It's a scandal that any company could use the swine flu pandemic as an opportunity to jack up profits. 'The Government should step in and impose a windfall tax on private companies that have hit the jackpot as a result of the flu crisis.'

The big drive to create a viable alternative-energy future — by Detroit, multinationals such as IBM and BP, and Silicon Valley startups — is well-known. But there's another serious player in this sphere: the U.S. military, and especially DARPA [the Defense Advanced Research Projects Agency]. Created at the height of the Cold War to bolster U.S. military technology following the Soviet Union's Sputnik satellite launch, the agency has a long history of innovation. Most famously, DARPA's researchers first linked together computers at four locations in the early 1960s to form the ARPANET, a computer network for researchers that was the core of what eventually grew into the Internet. Other breakthroughs have helped lead to the commercial development of semiconductors, GPS, and UNIX, the widely used computer operating system. Can DARPA now score another double success by changing how both the military and civilian worlds consume and produce energy? DARPA's first goal is always to magnify the might of the U.S. armed forces. That's why Arlington (Va.)-based DARPA is devoting an estimated $100 million of its $3 billion annual budget to alternative energy. DARPA describes itself as an incubator of long-shot technologies too risky for almost anyone else to take on. The agency operates by issuing challenges to companies that are so tough they are called "DARPA-hard." Typically, DARPA requires contractors to come up with solutions that are orders of magnitude superior to current technology. In addition to spurring the development of palm-size fuel cells, DARPA has contracted with companies to miniaturize solar cells that would supplant the need for generators.
"The total potential federal government support could reach up to $23.7 trillion," says Neil Barofsky, the special inspector general for the Troubled Asset Relief Program, in a report released today on the government's efforts to fix the financial system. "The potential financial commitment the American taxpayers could be responsible for is of a size and scope that isn't even imaginable," said Rep. Darrell Issa, R-Calif., ranking member on the House Oversight and Government Reform Committee. "If you spent a million dollars a day going back to the birth of Christ, that wouldn't even come close to just $1 trillion -- $23.7 trillion is a staggering figure." The government has about 50 different programs to fight the current recession, including programs to bail out ailing banks and automakers, boost lending and beat back the housing crisis. So far they've cost taxpayers around $4 trillion. But Barofsky says if each federal agency spent the maximum potential amount involved in these initiatives, taxpayers could be on the hook for trillions more. The watchdog also warned today that hundreds of billions of taxpayer dollars could be lost if the government does not increase the transparency of the TARP program, which he says has grown to an unprecedented scope and scale. Requiring TARP recipients to report on how government funds are used is among the recommendations urged by Barofsky. He also wants the department to report on the values of its TARP portfolio so taxpayers know about the value of their investments.

In an interview with SPIEGEL, epidemiologist Tom Jefferson speaks about dangerous fear-mongering, misguided, money-driven research and why we should all be washing our hands a lot more often. SPIEGEL: Do you consider the swine flu to be particularly worrisome? Jefferson: There are some people who make predictions year after year, and they get worse and worse. None of them so far have come about, and these people are still there making these predictions. Sometimes you get the feeling that there is a whole industry almost waiting for a pandemic to occur. SPIEGEL: Who do you mean? Jefferson: The WHO and public health officials, virologists and the pharmaceutical companies. They've built this machine around the impending pandemic. And there's a lot of money involved, and influence, and careers, and entire institutions! And all it took was one of these influenza viruses to mutate to start the machine grinding. SPIEGEL: Do you think the WHO declared a pandemic prematurely? Jefferson: Don't you think there's something noteworthy about the fact that the WHO has changed its definition of pandemic? The old definition was a new virus, which went around quickly, for which you didn't have immunity, and which created a high morbidity and mortality rate. Now the last two have been dropped, and that's how swine flu has been categorized as a pandemic.

Public health experts are gearing up for swine flu vaccinations this fall in what could be the largest mass-immunization campaign since the polio vaccine was introduced more than 50 years ago. Local public health agencies will bear much of the responsibility for vaccinating the public. For now, there are more questions than answers with regard to flu vaccinations, including how much of the vaccine will be made, when it will available, and who will get it first. In fact, the federal government has not officially announced plans to make a vaccine widely available, although it is expected to do so by the end of summer. "There's still a lot of information we have to figure out, and we're learning as we go," said Dr. Mantu Davis, deputy health officer with the Alameda County Public Health Department. "It's definitely a larger vaccination than anything we've seen, or anything in my lifetime." California authorities designed a mass vaccination plan years ago, under the assumption of a deadly pandemic flu and a limited vaccine supply, said Dr. John Talarico with the state public health department's Center for Infectious Disease. That plan is being revised, given that swine flu seems to be fairly mild so far and that a relatively large amount of vaccine may be available, even if it's not enough to give to everyone at once. A swine flu vaccine is still being designed, and the World Health Organization reported last week that a licensed version may not be available until the end of the year - weeks after the start of the flu season. An unlicensed vaccine - one that is still being tested but is deemed safe enough for the general public - may be available sooner.

President Obama's "science czar," John Holdren, once floated the idea of forced abortions, "compulsory sterilization," and the creation of a "Planetary Regime" that would oversee human population levels and control all natural resources as a means of protecting the planet -- controversial ideas his critics say should have been brought up in his Senate confirmation hearings ... as director of the White House's Office of Science and Technology Policy. It appears that the senators who scrutinized him had no knowledge of the contents of a textbook he co-authored in 1977, Ecoscience: Population, Resources, Environment. The 1,000-page course book, which was co-written with environmental activists Paul and Anne Ehrlich, discusses and in one passage seems to advocate totalitarian measures to curb population growth, which it says could cause an environmental catastrophe. Holdren and his co-authors spend a portion of the book discussing possible government programs that could be used to lower birth rates. Holdren's office issued a statement to FOXNews.com denying that the ecologist has ever backed any of the measures discussed in his book. Holdren's co-authors, Paul and Anne Ehrlich, said in a statement that they were "shocked at the serious mischaracterization of our views and those of John Holdren," caused by what they called misreadings of the book.
A federal judge has ruled that CIA officials committed fraud to protect a former covert agent against an eavesdropping lawsuit and is considering sanctioning as many as six who worked at the agency, including former CIA Director George Tenet. According to court documents unsealed Monday, U.S. District Judge Royce Lamberth referred a CIA attorney, Jeffrey Yeates, for discipline. Lamberth also denied the CIA's renewed efforts under the Obama administration to keep the case secret because of what he calls the agency's "diminished credibility" in the case. The eavesdropping lawsuit was brought by a former agent with the Drug Enforcement Agency, Richard Horn, who says his home in Rangoon, Burma, was illegally wiretapped by the CIA in 1993. He says Arthur Brown, the former CIA station chief in Burma, and Franklin Huddle Jr., the chief of mission at the U.S. Embassy in Burma, were trying to get him relocated because they disagreed with his work with Burmese officials on the country's drug trade. Horn sued Brown and Huddle in 1994, seeking damages for violations of his civil rights because of the alleged wiretapping. Tenet filed an affidavit in 2000 asking that the case against Brown be dismissed because he was a covert agent whose identity must not be revealed in court. Lamberth granted the CIA's request and threw out the case against Brown in 2004. But Lamberth found out last year that Brown's cover had been lifted in 2002, even though the CIA continued to file legal documents saying his status was covert. The judge found that the CIA intentionally misled the court and reinstated the case against Brown.

The most consequential decision of the Supreme Court’s last term got only a little attention when it landed in May. And what attention it got was for the wrong reason. But the lower courts have certainly understood the significance of the decision, Ashcroft v. Iqbal, which makes it much easier for judges to dismiss civil lawsuits right after they are filed. They have cited it more than 500 times in just the last two months. On its face, the Iqbal decision concerned the aftermath of the Sept. 11 attacks. The court ruled that a Muslim man swept up on immigration charges could not sue two Bush administration officials for what he said was the terrible abuse he suffered in detention. But something much deeper and broader was going on in the decision, something that may unsettle how civil litigation is conducted in the United States. For more than half a century, it has been clear that all a plaintiff had to do to start a lawsuit was to file what the rules call “a short and plain statement of the claim” in a document called a complaint. Information about wrongdoing is often secret. Plaintiffs claiming they were the victims of employment discrimination, a defective product, an antitrust conspiracy or a policy of harsh treatment in detention may not know exactly who harmed them and how before filing suit. But plaintiffs can learn valuable information during discovery. The Iqbal decision now requires plaintiffs to come forward with concrete facts at the outset, and it instructs lower court judges to dismiss lawsuits that strike them as implausible. “It obviously licenses highly subjective judgments,” said Stephen B. Burbank, an authority on civil procedure at the University of Pennsylvania Law School. “This is a blank check for federal judges to get rid of cases they disfavor.”

The senior senator from Alaska, Ted Stevens, enjoyed a reputation for inserting projects into the federal budget to benefit his home state, most notoriously a $223 million bridge from the town of Ketchikan to, well, not much of anyplace. In 1988, [physics] researchers sat down with Stevens and assured him that an ionospheric heater would be a bona fide scientific marvel and a guaranteed job creator, and it could be built for a mere $30 million. Just like that, the Pentagon had $10 million for ionospheric heater research. In a series of meetings in the winter of 1989-90, the field's leading lights ... pitched the Navy and the Air Force. Haarp, they asserted, could lead to "significant operational capabilities." They'd build a giant phased antenna array that would aim a finely tuned beam of high-frequency radio waves into the sky. The beam would excite electrons in the ionosphere, altering that spot's conductivity and inducing it to emit its own extremely low frequency waves, which could theoretically penetrate the earth's surface to reveal hidden bunkers or be used to contact deeply submerged submarines. Of course, the scientists said, you'd need a brand-new, state-of-the-art ionospheric heater to see if any of this was even feasible. The Pentagon ... began using Stevens' earmarked cash to fund the appropriate studies. For more than a year, planning proceeded largely out of public view. Then, in 1993, an Anchorage teachers' union rep named Nick Begich—son of one of Alaska's most important political families—found a notice about Haarp in the Australian conspiracy magazine Nexus. In 1995, he self-published a book, Angels Don't Play This HAARP. It sold 100,000 copies. He started giving speeches on Haarp's dangers everywhere, from UFO conventions to the European Parliament.

The last time the government embarked on a major vaccine campaign against a new swine flu, thousands filed claims contending they suffered side effects from the shots. This time, the government has already taken steps to head that off. Vaccine makers and federal officials will be immune from lawsuits that result from any new swine flu vaccine, under a document signed by Secretary of Health and Human Services Kathleen Sebelius, government health officials said Friday. Since the 1980s, the government has protected vaccine makers against lawsuits over the use of childhood vaccines. The document signed by Sebelius last month grants immunity to those making a swine flu vaccine, under the provisions of a 2006 law for public health emergencies. It allows for a compensation fund, if needed. The government takes such steps to encourage drug companies to make vaccines, and it's worked. Federal officials have contracted with five manufacturers to make a swine flu vaccine. The last time the government faced a new swine flu virus was in 1976. Federal officials vaccinated 40 million Americans during a national campaign. A pandemic never materialized, but thousands who got the shots filed injury claims, saying they suffered a paralyzing condition called Guillain-Barre Syndrome or other side effects.

While you were undercover in the family doing the reporting for Harper‘s and for your book, you actually attended a meeting between Congressman [Rep. Todd Tiahrt, Republican of Kansas] and Doug Coe, who is the long-time leader of the family. What happened at that meeting and what impression did you get of Mr. Tiahrt‘s position in the family? SHARLET: Yes. It was a spiritual counseling session, precisely the sort that Ensign and Sanford were having. Tiahrt also sort of had sex on the brain but of a different sort. He was very concerned with the number of babies Muslims are having. He said Americans are killing too many of their babies while Muslims are having too many, and we need to have more babies and outlaw abortion so that we can win the race with the Muslims. What happened was that Doug Coe, the leader of the family, said that‘s fine as far as it goes, but doesn‘t go far enough. He said to Congressman Tiahrt, “I want you to think bigger. I want you to think of Jesus plus nothing,” that‘s what he said. It‘s a phrase they mean to suggest something they call the totalitarianism of Christ. I think he was introducing Tiahrt into the sort of the advanced lessons of the family.

CIA director Leon Panetta just told Congress he cancelled a secret operation to assassinate al-Qaida leaders. The CIA campaign, authorized in 2001, had not yet become operational, claimed Panetta. His claim is humbug. The U.S. has been trying to kill al-Qaida personnel (real and imagined) since the Clinton administration. These efforts continue under President Barack Obama. Claims by Congress it was never informed are hogwash. The CIA and Pentagon have been in the assassination business since the early 1950s, using American hit teams or third parties. Assassination was outlawed in the U.S. in 1976, but that did not stop attempts by its last three administrations to emulate Israel's Mossad in the "targeted killing" of enemies. The George W. Bush administration, and now the Obama White House, sidestepped American law by saying the U.S. was at war, and thus legally killing "enemy combatants." But Congress never declared war. Washington is buzzing about a secret death squad run by Dick Cheney when he was vice-president and his protege, the new U.S. commander in Afghanistan, Gen. Stanley McChrystal. This gung-ho general led the Pentagon's super secret Special Operations Command, which has become a major rival to the CIA in the business of "wet affairs" (as the KGB used to call assassinations) and covert raids. America is hardly alone in trying to rub out enemies or those who thwart its designs. Britain's MI-6 and France's SDECE were notorious for sending out assassins. U.S. assassins are still at work. In Afghanistan and Pakistan, U.S. drones are killing tribesmen almost daily. Over 90% are civilians. Americans have a curious notion that killing people from the air is not murder or even a crime, but somehow clean.

Worldwide cases of the new H1N1 swine flu virus are spreading so fast that overwhelmed global health officials have stopped counting and officials with the U.S Centers for Disease Control and Prevention say they'll soon follow suit. "We don't know the extent of the challenges that we'll face in the weeks and months ahead," said Dr. Anne Schuchat, director of the National Center for the Immunization and Respiratory Diseases. Schuchat did not elaborate on how the CDC would inform the public about the extent of the outbreak, which has been confirmed in more than 40,600 people and implicated in 263 deaths in the United States. WHO had reported nearly 95,000 cases including 429 deaths worldwide. Earlier Friday, WHO officials said tracking individual swine flu cases is too overwhelming for countries where the virus is spreading widely. WHO will no longer issue global totals of swine flu cases, although it will continue to track the global epidemic.

The original recordings of the first humans landing on the moon 40 years ago were erased ... NASA officials said. NASA released the first glimpses of a complete digital make-over of the original landing footage that clarifies the blurry and grainy images of Neil Armstrong and Buzz Aldrin walking on the surface of the moon. The full set of recordings [is] being cleaned up by Burbank, California-based Lowry Digital. NASA admitted in 2006 that no one could find the original video recordings of the July 20, 1969, landing. Since then, Richard Nafzger, an engineer at NASA’s Goddard Space Flight Center in Maryland, who oversaw television processing at the ground-tracking sites during the Apollo 11 mission, has been looking for them. The good news is he found where they went. The bad news is they were part of a batch of 200,000 tapes that were degaussed - magnetically erased - and re-used to save money. “We should have had a historian running around saying ‘I don’t care if you are ever going to use them - we are going to keep them’,” he said. They found good copies in the archives of CBS news and some recordings ... in film vaults at Johnson Space Center. Lowry, best known for restoring old Hollywood films, has been digitizing these ... to make a new rendering of the original landing. And there may be some unofficial copies of the original broadcast out there somewhere that were taken from a NASA video switching center in Sydney, Australia.

However careful you are about your health, your body is almost certainly home to troubling chemicals called phthalates. These are ubiquitous in modern life, found in plastic bottles, cosmetics, some toys, hair conditioners, and fragrances — and many scientists have linked them to everything from sexual deformities in babies to obesity and diabetes. The problem is that phthalates suppress male hormones and sometimes mimic female hormones. Chemicals called endocrine disruptors are believed to explain the proliferation of “intersex fish” — male fish that produce eggs — as well as sexual deformities in animals and humans. Phthalates ... are among the most common endocrine disruptors, and among the most difficult to avoid. They’re even in tap water, and levels soar in certain plastic water bottles. In girls, some research suggests that phthalates may cause early onset puberty. Most vulnerable of all, it seems, are male fetuses in the first trimester of pregnancy, just as they are differentiating their sex. At that stage, scholars believe, phthalates may “feminize” these boys. “Commonly used phthalates may undervirilize humans,” concluded a study by the University of Rochester. There has also been a flurry of scientific articles questioning whether endocrine disruptors are tied to obesity, autism and allergies, although the evidence there is less firm than with genital abnormalities and depressed sperm count. Dr. Theo Colborn, the founder of the Endocrine Disruption Exchange, ... tells researchers working with her to toss out plastic water bottles and use stainless steel instead. “I don’t have plastic food containers in my house,” she added. “I use glass.”

Berkeley's Mike Hannigan gives most of his money away. It started in 1991. He had about $20,000 in his bank account and thought about all the good it could do in the world. With partner Sean Marx, he started Give Something Back Inc., an office supply firm that now gives away up to 80 percent of its profit. The company has given away about $4 million to community charities over the last 18 years. That puts Hannigan in a small circle of individuals who are recognized for giving away at least half their income, profit or personal wealth. This so-called "50 percent league" is the brainchild of a national nonprofit organization called Bolder Giving, which has highlighted these givers since its inception in 2007 in the hope that others will take a closer look at how much they give and how much more they could afford to contribute. Every year, the average U.S. household donates about 3 percent of its income. Yet deep in the heart of this recession there is a growing group giving away at least half of what they've got. Currently, 125 individuals or families are on the 50 percent club list and Bolder Giving, based in Arlington, Mass., is looking for more members. At Hannigan's Oakland-based company, the vast majority of the profits go to charities selected by customers and employees. Food banks and education-related organizations are among the most frequent recipients, Hannigan said. It's a way "to use the business as a mechanism to circulate wealth throughout the community," he said. The 59-year-old businessman doesn't consider himself a philanthropist, but an activist who lives a comfortable life.
